Online dispute resolution (ODR) means settling a dispute through negotiation, mediation or arbitration run online instead of in a courtroom. In India it has grown quickly because of the volume of small-value disputes from lending, e-commerce and insurance, and because Indian courts carry a backlog of crores of pending cases. JurisGrid tracks 127 Indian legal tech startups in 12 sectors; the Dispute Resolution (ODR) sector currently has 8 of them.

The 8 ODR platforms (alphabetical)

How the three methods differ

  • Negotiation: the two sides try to agree directly; the platform gives them a structured, recorded space to do it.
  • Mediation: a neutral mediator helps the sides reach a settlement. Nothing is imposed; the outcome is what both accept.
  • Arbitration: an arbitrator hears both sides and makes an award that binds them, under the Arbitration and Conciliation Act, 1996.

Most of the platforms above offer more than one of these, so the first question is which method your contract or situation calls for.

How to choose an ODR platform

  1. Check your contract. Many loan and commercial agreements already name an arbitration institution or ODR provider.
  2. Match the dispute type. Some platforms focus on high-volume consumer or lending disputes; others on commercial or institutional arbitration.
  3. Ask about the neutrals. Who are the mediators or arbitrators, and how are they appointed?
  4. Ask about cost and timelines before you begin, and get them in writing.
  5. Keep records. Download every notice, submission and award.

Debt recovery and collections (7 companies) and verification and diligence (11 companies) overlap with ODR, because many disputes start as unpaid loans or checks on a counterparty. Court data platforms such as eCourtsIndia (position 1 on the grid) help when a dispute has already reached court.

FAQ

Is an ODR award binding?

An arbitration award made under the Arbitration and Conciliation Act, 1996 binds the parties and can be enforced like a court decree. A mediated settlement depends on what the parties sign.
